Terms of Use Agreement

This Terms of Use Agreement ("Agreement") is a legally binding contract between you ("User" or "you") and Desirefit App Company ("Desirefit" or "we" or "us"), governing your use of the Desirefit mobile application (the "App") and related services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by this Agreement. If you do not agree with any part of this Agreement, you should not use the Platform.

1. Eligibility: 1.1 You must be at least 18 years old or the age of majority in your jurisdiction to use the Platform. By using the Platform, you represent and warrant that you meet the eligibility requirements. 1.2 If you are using the Platform on behalf of a company or organization, you represent and warrant that you have the authority to bind such entity to this Agreement.

2. User Account Creation: 2.1 In order to access certain features of the Platform, you may need to create a user account. 2.2 You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. 2.3 You agree to provide accurate and complete information during the account registration process and to update such information as necessary to ensure its accuracy.

3. Security, Suspension, and Termination: 3.1 You are responsible for maintaining the security of your account and for any actions taken using your account. 3.2 Desirefit reserves the right to suspend or terminate your access to the Platform, at its sole discretion, if it believes you have violated any provision of this Agreement or if your account has been inactive for an extended period. 3.3 Desirefit also reserves the right to modify or discontinue the Platform, or any part thereof, with or without notice.

4. Subscription Service: 4.1 The Platform may offer a subscription service ("Subscription Service") that provides access to additional features and content. 4.2 By subscribing to the Subscription Service, you agree to pay the applicable fees and any taxes associated with your use of the Subscription Service. 4.3 Subscription fees are non-refundable unless otherwise stated in this Agreement.

5. Subscription: 5.1 The Subscription Service may be offered on a monthly or annual basis, as specified in the App. 5.2 By subscribing to the Subscription Service, you authorize Desirefit to charge the applicable fees to your designated payment method. 5.3 The Subscription will automatically renew at the end of each billing period unless you cancel the Subscription in accordance with the cancellation provisions of this Agreement.

6. Free Trial: 6.1 Desirefit may offer a free trial period for the Subscription Service. 6.2 If you sign up for a free trial, you may be required to provide your payment details. 6.3 At the end of the free trial period, your Subscription will automatically renew and you will be charged the applicable fees, unless you cancel the Subscription before the trial period expires.

7. Payment Details: 7.1 You agree to provide accurate and complete payment information when subscribing to the Subscription Service. 7.2 You authorize Desirefit to charge the fees to your designated payment method. 7.3 You are responsible for ensuring that your payment details are up to date and that there are sufficient funds in your account to cover the fees.

8. Automatic Renewal of Subscription: 8.1 Unless you cancel your Subscription in accordance with this Agreement, your Subscription will automatically renew at the end of each billing period. 8.2 Desirefit will notify you of any changes to the Subscription fees or other terms of the Subscription Service prior to the renewal.

9. Cancellation and Refund of Subscription Fees: 9.1 You may cancel your Subscription at any time through the App or by contacting Desirefit's customer support. 9.2 Cancellation requests must be received before the renewal date to avoid being charged for the next billing period. 9.3 Subscription fees are non-refundable unless otherwise stated in this Agreement.

10. User of the Platform: 10.1 You are solely responsible for your use of the Platform and for any content or information you upload, post, or transmit through the Platform. 10.2 You agree not to use the Platform for any illegal or unauthorized purpose, and you will comply with all applicable laws and regulations.

11. Contributed Content: 11.1 By uploading, posting, or transmitting any content through the Platform, you grant Desirefit a worldwide, non-exclusive, royalty-free license to use, modify, reproduce, distribute, and display such content for the purpose of providing and promoting the Platform. 11.2 You represent and warrant that you have all necessary rights and permissions to grant the foregoing license.

12. Availability of Service and Security: 12.1 Desirefit strives to provide a reliable and secure Platform but does not guarantee that the Platform will be available without interruption or error-free. 12.2 You acknowledge that the internet is not completely secure and that Desirefit cannot guarantee the security of your personal information or content transmitted through the Platform.

13. Intellectual Property Use License: 13.1 The Platform and its content, including but not limited to text, graphics, images, logos, trademarks, and software, are the intellectual property of Desirefit or its licensors and are protected by intellectual property laws. 13.2 Desirefit grants you a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes, in accordance with this Agreement.

14. Third-Party Services and Content: 14.1 The Platform may include links to third-party websites or services that are not owned or controlled by Desirefit. 14.2 Desirefit is not responsible for the availability or content of these third-party websites or services. 14.3 Your use of any third-party websites or services is subject to the terms and conditions and privacy policies of those websites or services.

15. Limitations of Liability: 15.1 To the fullest extent permitted by law, Desirefit shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with your use of the Platform or this Agreement. 15.2 Desirefit's total liability under this Agreement, whether in contract, tort, or otherwise, shall not exceed the amount paid by you, if any, for the Subscription Service during the twelve (12) months preceding the event giving rise to the liability.

16. Disclaimer: 16.1 The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. 16.2 Desirefit disclaims all warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

17. Indemnity: 17.1 You agree to indemnify and hold Desirefit and its officers, directors, employees, and agents harmless from any claims, damages, liabilities, and expenses arising out of or in connection with your use of the Platform or any violation of this Agreement.

18. Changes and Updates to Platform Terms of Use: 18.1 Desirefit reserves the right to modify or update this Agreement at any time, without prior notice. 18.2 Any changes or updates to this Agreement will be effective upon posting the revised version on the Platform. 18.3 Your continued use of the Platform after the posting of any changes or updates constitutes your acceptance of such changes or updates.

19. Complaints, Governing Law, and Dispute Resolution: 19.1 If you have any complaints or concerns regarding the Platform, please contact Desirefit's customer support. 19.2 This Agreement shall be governed by and construed in accordance with the laws of [Jurisdiction]. 19.3 Any dispute arising out of or in connection with this Agreement shall be resolved through good faith negotiations. If a resolution cannot be reached, the dispute shall be submitted to binding arbitration in accordance with the rules of [Arbitration Service]. 19.4 The language of arbitration shall be [language], and the arbitration shall be conducted in [Jurisdiction].

20. General: 20.1 This Agreement constitutes the entire agreement between you and Desirefit regarding your use of the Platform and supersedes any prior or contemporaneous agreements. 20.2 If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. 20.3 Desirefit's failure to enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. 20.4 You may not assign or transfer this Agreement, in whole or in part, without Desirefit's prior written consent. 20.5 Desirefit may assign or transfer this Agreement without your consent.

Forum Community Guidelines Addendum: As a user of the Desirefit community forum, you agree to abide by the following guidelines:

1. Be respectful and courteous towards other forum members.

2. Do not post or share any harmful, offensive, or illegal content.

3. Avoid engaging in personal attacks, harassment, or discrimination.

4. Stay on topic and contribute constructively to discussions.

5. Do not spam the forum with unrelated or promotional content.

6. Respect the privacy of other forum members and do not share personal information without their consent.

7. Desirefit reserves the right to moderate or remove any content that violates these guidelines.

8. Desirefit is not responsible for the accuracy or reliability of any information shared on the forum.

By using the Desirefit App and Platform, you acknowledge that you have read, understood, and agree to be bound by this Terms of Use Agreement, including the Forum Community Guidelines Addendum.
